The Nigeria Labour Congress (NLC) and the Trade Union Congress of Nigeria (TUC) have vehemently condemned the recent declaration of a state of emergency in Rivers State by President Bola Tinubu, calling the decision hasty and unconstitutional. The unions, representing millions of Nigerian workers, have demanded the immediate reversal of the declaration, stating that it violates the country’s constitutional provisions.
In a joint statement issued on Wednesday, the NLC, led by Joe Ajaero, and the TUC, under the leadership of Festus Osifo, expressed their deep concern over the move, which they argue constitutes a direct violation of Part II, Section 305 of the 1999 Constitution (as amended). The unions pointed out that the emergency rule, as declared by the President, was not in line with the legal processes outlined in the Constitution, highlighting a potential overreach of executive power.
The labour bodies have been vocal about the need to uphold constitutional limits and democratic integrity. They argued that such a declaration, made without following due constitutional process, undermines the rule of law and sets a dangerous precedent for the country’s governance.
The statement emphasized that President Tinubu must revoke what the unions referred to as the “unconstitutional declaration,” urging him to align with Section 305(6) of the Constitution.
This section outlines the legal steps necessary for declaring and maintaining a state of emergency in the country.
Joe Ajaero and Festus Osifo further noted that the President, as the custodian of the nation’s executive powers, must act with restraint. They underscored that it is vital for the President to respect constitutional boundaries and avoid taking actions that could breed distrust and uncertainty among the public.
According to the unions, the President’s actions should reflect the values of constitutional democracy, fostering national confidence rather than sowing seeds of suspicion.
