2025 Annual General Conference: NBA Relocates Event From Rivers To Enugu Over ‘Unconstitutional’ Emergency Rule

In a landmark decision underscoring its commitment to constitutionalism and democratic governance, the Nigerian Bar Association (NBA) has announced the relocation of its 2025 Annual General Conference (AGC) from Port Harcourt, Rivers State, to Enugu.

This move follows the controversial declaration of a state of emergency in Rivers State by President Bola Tinubu on March 18, 2025, and the subsequent appointment of a sole administrator to govern the state—an action the NBA deems unconstitutional.

The announcement was made in a joint statement late Thursday night, signed by NBA President Afam Osigwe (SAN), General Secretary Mobolaji Ojibara, and AGC Planning Committee Chairman Emeka Obegolu (SAN).

“The appointment of a retired military officer, who governs with a command-style approach, flouting court rulings and constitutional provisions, means Port Harcourt can no longer serve as a viable host for our flagship event,” the statement read.

According to the NBA, the current administration in Rivers State has suspended elected officials and democratic institutions, replacing them with an unelected sole administrator. Though operating in civilian attire, the association noted that the administrator’s methods are “military in nature” and pose a direct threat to the rule of law.

The NBA’s National Executive Council (NEC) held an emergency session on March 27, 2025, where it unanimously agreed that proceeding with the AGC in Rivers would amount to tacit approval of an unconstitutional regime.

Citing Sections 305, 11, and 188 of the 1999 Constitution, the association strongly condemned the state of emergency as unlawful. It further criticized the National Assembly’s ratification of the measure via a voice vote, rather than the constitutionally required two-thirds majority.

In light of these concerns, the NBA has now chosen Enugu, fondly known as the Coal City, to host the 2025 conference. The association expressed confidence in Enugu’s capacity to deliver a memorable and impactful event.

“With unity, diligence, and a shared commitment to our values, we will make this transition a resounding success,” the statement concluded, calling on members and stakeholders to rally behind the new direction.

This decision reinforces the NBA’s role not just as a professional body, but as a vital watchdog of Nigeria’s democratic and constitutional integrity.
